R3CON Timepieces Terms of Service

These Terms of Service govern access to and use of the R3CON Timepieces website, online store, products, content, and related services. Throughout these Terms, “R3CON Timepieces,” “R3CON,” “we,” “us,” and “our” refer to R3CON Timepieces. “Customer,” “you,” and “your” refer to any person who accesses the website or purchases, attempts to purchase, or uses a product or service offered by R3CON Timepieces.

By accessing our website, submitting an order, creating an account, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service. If you do not agree to these Terms, you may not use the website or purchase products through our online store.

1. Online Store Terms

You must be at least the age of majority in your state, province, or country of residence to use this website or submit an order. If you permit a minor to access the website through a device, account, or payment method under your control, you accept responsibility for that activity to the extent permitted by law.

You may not use our products, website, or services for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not violate any applicable law, regulation, intellectual-property right, or contractual obligation while using the website.

A violation of these Terms may result in suspension or termination of access, cancellation of an order where legally permitted, denial of service, or other appropriate action.

2. Shopify Hosting

The R3CON Timepieces online store is hosted by Shopify. Shopify provides the e-commerce platform that allows R3CON Timepieces to display and sell products.

Purchases made through the website are transactions between the customer and R3CON Timepieces. Shopify is not the seller of R3CON products and is not responsible for the fulfillment, warranty, servicing, or performance of those products.

Shopify and other authorized service providers may collect and process information necessary to operate the store, process transactions, prevent fraud, provide platform services, and perform other functions described in our Privacy Policy and their respective privacy notices.

3. Product Information

R3CON Timepieces makes reasonable efforts to present product descriptions, specifications, photographs, colors, measurements, finishes, and other information accurately. However, the appearance of a product may vary because of lighting, photography, screen settings, production tolerances, material variations, or subsequent product improvements.

Images may include digital renderings, prototypes, preproduction samples, or enlarged details intended to illustrate a product. Minor variations that do not materially affect the function or overall character of a product will not necessarily constitute a defect.

R3CON Timepieces may correct, revise, or update product information at any time. We may also modify or discontinue a product, color, configuration, component, specification, or service without prior notice, subject to accepted orders and applicable law.

4. Prices and Payment

All prices are displayed in the currency identified at checkout and may be changed without notice. A price change will not ordinarily affect an order that has already been accepted, except when correction is necessary because of an obvious pricing, technical, or typographical error and applicable law permits the correction.

Prices do not include taxes, duties, import charges, customs fees, brokerage fees, or other governmental assessments unless expressly stated. Customers are responsible for charges associated with an international shipment when those charges are not collected during checkout.

You represent that:

• The payment information submitted is complete and accurate;

• You are authorized to use the selected payment method;

• Sufficient funds or credit are available to complete the transaction; and

• You will promptly update any information necessary to complete or service the order.

Payment authorization does not guarantee acceptance of an order.

5. Order Acceptance and Cancellation

An order confirmation acknowledges that R3CON Timepieces received your order. It does not necessarily mean that the order has been accepted or that the product is available.

R3CON Timepieces reserves the right, where permitted by law, to accept, reject, limit, or cancel an order for reasons that may include:

• Product unavailability;

• Incorrect product or pricing information;

• Suspected payment fraud or unauthorized activity;

• Purchase limits associated with a limited release;

• Reseller or automated purchasing activity;

• Inability to verify billing, shipping, or customer information;

• A violation of these Terms or another R3CON Timepieces policy; or

• Circumstances that prevent lawful or commercially reasonable fulfillment.

If R3CON Timepieces cancels an order after payment has been collected, the appropriate amount will be refunded to the original payment method unless another lawful arrangement has been agreed upon.

6. Limited Releases and Purchase Limits

Certain R3CON Timepieces products may be released in limited quantities or individually numbered editions. Product availability is not guaranteed until an order has been accepted and payment has been successfully processed.

R3CON Timepieces may establish purchase limits per customer, household, account, payment method, billing address, shipping address, or other identifying information. Orders that appear intended to avoid a purchase limit may be combined, reduced, or canceled where permitted by law.

The availability of a product in a shopping cart does not reserve inventory. A product may sell out before checkout is completed.

7. Preorders, Backorders, and Made-to-Order Products

Preorders, limited-production reservations, backorders, and made-to-order purchases are governed by the R3CON Timepieces Return and Refund Policy.

Unless applicable law provides otherwise, these purchases are considered final and may not be canceled or refunded because inventory, materials, or production capacity may be reserved specifically for the purchaser.

Production and shipping dates provided for these products are estimates rather than guaranteed delivery dates. Estimates may change because of component availability, production scheduling, quality-control requirements, carrier interruptions, or circumstances outside the reasonable control of R3CON Timepieces.

When a delay occurs, R3CON Timepieces will provide any notice, cancellation opportunity, consent request, or refund required by applicable law.

8. Shipping and Delivery

Shipping and delivery are governed by the R3CON Timepieces Shipping Policy.

Processing and delivery estimates are provided in good faith but are not guaranteed. Delivery may be affected by carrier operations, customs processing, weather, labor interruptions, address errors, security reviews, holidays, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. R3CON Timepieces is not responsible for delays or additional expenses caused by inaccurate or incomplete information submitted by the customer, except where applicable law provides otherwise.

International customers are responsible for understanding and complying with local import requirements. Customs duties, taxes, brokerage fees, and related charges may be collected by the destination country or carrier and remain the customer’s responsibility unless expressly included at checkout.

9. Returns, Refunds, and Exchanges

Returns, refunds, store credits, and exchanges are governed by the R3CON Timepieces Return and Refund Policy in effect when the applicable order is placed, subject to any nonwaivable rights provided by law.

Before returning a product, the customer must obtain authorization and return instructions from R3CON Timepieces Customer Support. Sending a product without authorization does not guarantee acceptance, refund, exchange, or store credit.

R3CON Timepieces reserves the right to inspect returned products and determine whether the applicable return requirements have been satisfied.

10. Product Warranty

Eligible R3CON timepieces are covered only by the express written limited warranty published by R3CON Timepieces and any warranties that cannot legally be excluded.

Warranty eligibility may depend on valid proof of purchase, the identity of the original purchaser, the product’s condition, and compliance with the warranty terms. Unauthorized modification, misuse, abuse, accidental damage, improper service, or repair performed outside an authorized service channel may affect warranty coverage.

Nothing in these Terms limits a warranty or consumer right that cannot lawfully be limited or excluded.

11. Flagged Timepieces and Ownership Verification

R3CON Timepieces may maintain internal records concerning watches reported as lost or stolen, connected to payment fraud or chargeback abuse, involved in a credible ownership dispute, or materially altered in a manner affecting authenticity or identification.

If a watch is flagged, R3CON Timepieces may withhold or limit warranty service, repair intake, authentication assistance, or ownership-transfer support while lawful ownership is reviewed.

R3CON Timepieces may request proof of purchase, order records, identifying photographs, serial-number information, identification, or other reasonably necessary documentation. Possession of a watch alone does not guarantee warranty eligibility, service eligibility, authenticity confirmation, or recognition of ownership.

R3CON Timepieces may retain relevant internal records and cooperate with law-enforcement agencies, payment providers, carriers, insurers, or other appropriate authorities when permitted or required by law.

12. Accounts and Account Security

If you create a customer account, you are responsible for maintaining the confidentiality of your login credentials and restricting access to your account and devices.

You agree to provide accurate, complete, and current information. You must notify R3CON Timepieces promptly if you believe your account or payment information has been accessed or used without authorization.

R3CON Timepieces may suspend or terminate an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms, or comply with legal obligations.

13. Intellectual Property

The website and its content—including the R3CON name, trademarks, logos, watch designs, product names, photographs, graphics, videos, text, layouts, and other materials—are owned by or licensed to R3CON Timepieces and are protected by applicable intellectual-property laws.

Access to the website does not grant ownership of or a license to use R3CON intellectual property except for personal, noncommercial viewing of the website.

Without prior written permission, you may not reproduce, distribute, modify, publish, sell, license, create derivative works from, commercially exploit, or use R3CON content in a manner likely to cause confusion regarding sponsorship, endorsement, or affiliation.

14. Reviews, Photographs, and Customer Submissions

If you submit a review, photograph, video, testimonial, suggestion, comment, or other material to R3CON Timepieces, you represent that:

• You own the submission or have permission to provide it;

• The submission is truthful and based on your genuine experience where applicable;

• The submission does not infringe another person’s rights;

• The submission does not contain unlawful, defamatory, threatening, deceptive, or malicious material; and

• The submission does not contain malicious code, unauthorized advertising, or confidential information.

To the extent permitted by law, you grant R3CON Timepieces a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute the submission in connection with our business and marketing activities.

R3CON Timepieces may moderate or remove customer submissions but is not obligated to do so.

15. Prohibited Conduct

You may not:

• Use the website for unlawful or fraudulent activity;

• Submit false ordering, billing, shipping, ownership, or identity information;

• Interfere with the website’s operation or security;

• Introduce malware, viruses, or harmful code;

• Scrape, harvest, copy, or extract website content through unauthorized automated means;

• Circumvent purchase limits or security controls;

• Impersonate another person or misrepresent an affiliation;

• Infringe intellectual-property, privacy, or publicity rights;

• Use website content to develop or promote counterfeit or unauthorized products;

Personal information submitted through the website is governed by the R3CON Timepieces Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other authorized providers that support payment processing, fraud prevention, fulfillment, analytics, communications, customer service, and store operations.

18. Errors and Omissions

The website may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, promotions, availability, shipping charges, delivery estimates, or other information.

R3CON Timepieces may correct an error, update information, or cancel an affected order where permitted by law. If an order is canceled after payment has been collected, the applicable amount will be refunded.

19. Disclaimer of Warranties

Except for an express written product warranty provided by R3CON Timepieces and warranties that cannot legally be excluded, the website and related services are provided on an “as available” basis.

To the fullest extent permitted by law, R3CON Timepieces disclaims implied warranties concerning the website and services, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

R3CON Timepieces does not warrant that the website will always be uninterrupted, secure, timely, or free from errors or harmful components.

This section does not eliminate or reduce any statutory warranty, consumer guarantee, or other right that cannot legally be waived.

20. Limitation of Liability

To the fullest extent permitted by applicable law, R3CON Timepieces and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of, or inability to use, the website, products, or related services.

Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless R3CON Timepieces and its owners, officers, employees, contractors, affiliates, licensors, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from:

• Your unlawful use of the website;

• Your material violation of these Terms;

• Your infringement of another party’s rights; or

• Fraudulent, abusive, or intentionally harmful conduct attributable to you.

This provision does not require a consumer to indemnify R3CON Timepieces for the Company’s own unlawful conduct, negligence, or breach of these Terms.

22. Events Outside Our Reasonable Control

R3CON Timepieces will not be responsible for a delay or failure caused by circumstances outside its reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, epidemics, government action, labor disruption, supply-chain interruption, utility failure, carrier interruption, or widespread communications failure.

This section does not remove any cancellation, refund, notice, or other right provided by applicable law.

23. Termination

These Terms remain effective unless terminated by you or R3CON Timepieces.

You may stop using the website at any time. R3CON Timepieces may suspend or terminate access when it reasonably believes that a user has violated these Terms, created a security or fraud risk, or used the website unlawfully.

Provisions that by their nature should survive termination—including intellectual-property, limitation-of-liability, indemnification, and dispute-related provisions—will remain effective.

24. Governing Law

These Terms and any transaction with R3CON Timepieces will be governed by the laws applicable in the jurisdiction where R3CON Timepieces maintains its principal place of business, without regard to conflict-of-law principles.

This provision does not deprive a consumer of mandatory protections provided by the laws of the consumer’s place of residence or another jurisdiction whose protections cannot lawfully be waived.

25. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will continue in effect.

26. No Waiver

A failure by R3CON Timepieces to enforce a provision of these Terms does not waive the right to enforce that provision or any other provision in the future.

27. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return and Refund Policy, Limited Warranty, Flagged Watch Policy, and any other policies or terms expressly presented during checkout, constitute the agreement between the customer and R3CON Timepieces concerning use of the website and the applicable purchase.

If a product-specific term conflicts with these general Terms, the product-specific term will control for that product to the extent of the conflict.

28. Changes to These Terms

R3CON Timepieces may revise these Terms to reflect changes in its business, website, products, services, or legal obligations.

The current version will be posted on the website with an updated effective date. Changes will apply prospectively unless applicable law permits or requires otherwise.

Continued use of the website after revised Terms become effective constitutes acceptance of those revised Terms.
